What a penthouse is - definition and features
A penthouse is an apartment located on the top, or one of the top, floors of a multi-storey building. Unlike a standard unit in the same development, a penthouse stands out above all by giving the owner space that simply does not exist on the lower floors - a terrace with a view of the horizon, sometimes wrapping around several sides of the building, and in the most exclusive projects also a private pool at roof level or on its own floor.
Typical features that distinguish a penthouse on Phuket's new-build and resale markets:
- A private terrace often larger than the living area itself - from 40 to over 200 sqm, with a view of the sea, jungle or bay.
- A private pool or jacuzzi - in luxury projects built into the penthouse terrace, used exclusively by the owner.
- A panoramic sea-view apartment - the visibility from the top floor is unobstructed by any other buildings and remains permanent for the lifetime of the development.
- A high standard of finish - developers treat the penthouse as the project's showpiece: materials, appliances, bathrooms and joinery are generally of a higher class than in the other units.
- Larger floor areas - a penthouse often occupies an entire floor or a significant part of it; areas from 80 to over 300 sqm are typical for this segment in Phuket.
It is worth distinguishing a penthouse from the so-called sky villa or duplex penthouse, which span two floors connected by an internal staircase. Both terms operate in the same price segment and are often used interchangeably by developers.
- Penthouse = a top-floor apartment, usually with a private terrace and/or pool and a panoramic view.
- The terrace area can be larger than the living space - this is the main value alongside the view itself.
- The view from the top floor is permanent - no new development will block it.
- The premium segment: prices clearly above the project average, but also higher liquidity on the resale market and better rates for short-term rentals.
- Freehold purchase is possible within the 49% quota - the same procedure as for any apartment in a registered condominium.
Why a penthouse in Phuket attracts buyers from around the world
Phuket is one of the few places in the world where a single development can combine a tropical climate, a view of the Andaman Sea, extensive infrastructure and a legally stable title of ownership for a foreigner. It is a combination that in Southern Europe or the Caribbean costs many times more.
For a penthouse buyer, three aspects are especially important. First, the quality of the view - the Andaman Sea with a sunset panorama is one of the more spectacular views available from a private terrace in Southeast Asia. Second, the climate - for most of the year the temperature allows you to use the terrace and pool at practically any time of day or night. Third, the infrastructure - an international airport with direct connections to Europe, extensive medical care, restaurants and world-class shopping centres make Phuket suitable for a permanent, seasonal or investment residence.

Where to look for a penthouse for sale - locations in Phuket
Not every location in Phuket has buildings tall enough to speak of a true penthouse with an open sea view. Towers of 7 or more floors are concentrated above all in a few districts.
Bangtao and Laguna: a dynamically developing area in the north-west of the island, with extensive tourist and residential infrastructure. Towers built close to the beach offer penthouses with views over the lagoon and sea - for buyers who value active social life and proximity to restaurants.
Surin and Kamala: Surin is regarded as one of the most exclusive locations in Phuket - home to luxury hotels and boutique condo developments with a limited number of units. A penthouse in Surin is often the only unit on its floor, with a terrace running around the entire building. Kamala, directly to the south, offers similar prices and less intense tourist traffic, which is why buyers seeking peace and quiet are happy to choose units here. Patong: Phuket's entertainment hub - the most tourists and the highest short-term rental turnover. Towers in Patong's beachfront zone offer penthouses with views over Patong Bay. An ideal location for investors focused on liquidity and short-term rentals; less suitable for buyers seeking quiet and intimacy.

Freehold ownership - how a foreigner buys a penthouse in Phuket
As a rule, foreigners cannot buy a plot of land in Thailand on full ownership. The exception is units in a registered condominium (Condominium Act B.E. 2522): a foreign person may own an apartment on full freehold title (the so-called Chanote), provided that the total foreign share in the building does not exceed 49% of the floor area of the units.
A penthouse, being one of the units in a condo building, is subject to the same rules. For the buyer the procedure is as follows:
- The developer or seller confirms that the 49% quota is not exhausted - this is a standard requirement for the transaction and is not a problem in most new developments.
- The purchase price must be paid by a foreign-currency transfer from abroad or from a foreign-currency account at a Thai bank - the Thai Land Department requires an FET (Foreign Exchange Transaction Form) confirming the foreign origin of the funds.
- The transfer of title takes place at the Land Department - officially, onto the Chanote document. The owner receives the original title deed bearing their name.
Freehold is permanent ownership with no time limit - in contrast to the leasehold structure (a 30-year lease with an extension option), which is also found on the market. Prices - a penthouse for sale in Phuket in the premium segment
By definition, a penthouse is one of the most expensive units in a project - and this is not just about the larger floor area. Developers price the penthouse as an exclusive product, adding a so-called premium for the view and for its uniqueness. In practice this means that the price per square metre of a penthouse is higher than the project average - sometimes by 20-40%.
Indicative price ranges for penthouses in Phuket's beachfront locations (new-build and resale, data from 2025-2026):
- Entry-level premium segment (Patong, Karon, Kata): from around 15,000,000 THB for units of 100-150 sqm with a terrace and sea view.
- Ultra-premium segment (Surin, Kamala, Bangtao beach-front): from 25,000,000 THB for a penthouse with a private pool, rarely above 80,000,000 THB for the most spectacular projects.
- A duplex penthouse or sky villa with two floors and a large terrace around the building - prices on an individual basis, often from 30,000,000 THB upwards.
